Booking Terms & Conditions

These terms apply to photography and video production services provided by Tungl Media ehf. (Robert Arnar).

By confirming a booking, the client agrees to these terms together with the applicable project quote and any signed services agreement.

Where project-specific terms differ from these general terms, the signed services agreement takes precedence, followed by the accepted project quote.

1. Quotes & Pricing

Each project is quoted individually based on the client's requirements, scope and intended use of the final materials.

Quotes outline the agreed services, deliverables, usage rights, production schedule and fees. Unless otherwise stated, quotes remain valid for 30 days from the date of issue.

Any work, services or deliverables outside the agreed scope may be subject to additional fees. Any additional costs will be communicated and agreed upon before the work proceeds.

Applicable taxes and VAT will be identified in the project quote.

2. Booking Confirmation & Deposits

A booking is confirmed once the project quote or services agreement has been accepted and any required deposit has been received.

Dates and production resources are not reserved until the booking has been confirmed.

Any deposit or advance payment will be specified in the individual project quote and credited towards the total project fee unless otherwise agreed.

3. Changes & Additional Work

Any changes to the agreed project scope, deliverables, production schedule or location must be agreed upon in writing.

Changes may affect the project fee and delivery schedule.

Additional work, editing, revisions or deliverables beyond those included in the original agreement may incur additional charges.

4. Cancellation & Rescheduling

If a client wishes to cancel or reschedule a confirmed booking, written notice must be provided as soon as reasonably possible.

Cancellation fees, where applicable, will be determined according to the cancellation terms agreed in the individual services agreement.

Any cancellation charges will take into consideration the agreed terms, work already completed, costs incurred and applicable legal requirements.

If Tungl Media ehf. needs to cancel or reschedule a project, the client will be notified as soon as reasonably possible and alternative arrangements will be discussed.

Nothing in these terms limits any mandatory cancellation or withdrawal rights available to consumers under applicable law.

5. Weather & Unforeseen Circumstances

For outdoor productions, particularly in Iceland, weather conditions may affect the feasibility, safety or quality of a planned shoot.

Where conditions make production unsafe or impractical, an alternative date, location or production arrangement will be discussed.

Both parties will make reasonable efforts to accommodate changes while minimising disruption and additional costs.

Neither party will be held responsible for delays caused by circumstances beyond their reasonable control, including severe weather, natural events, government restrictions or other unforeseen circumstances.

6. Client Responsibilities

The client is responsible for providing accurate project information, necessary materials, access to agreed locations and timely approvals where required.

The client must ensure that any necessary permissions, location approvals, property access and third-party clearances required for the production are obtained.

Any delays resulting from missing information, approvals, access or materials may affect the production schedule and delivery date.

7. Production & Delivery

All projects are carried out according to the agreed creative direction, production scope and deliverables outlined in the project quote.

Final materials are professionally edited and colour-graded before delivery.

Delivery dates are agreed individually and may be adjusted where circumstances outside the production's reasonable control affect the schedule.

Unless specifically included in the agreement, RAW photographs, unedited video footage, project files and working materials are not included in the final delivery.

Delivered files are provided in the agreed formats and through the agreed delivery method.

8. Revisions & Amendments

The number of included revision rounds, where applicable, will be specified in the individual project quote.

Revision requests must remain within the original agreed creative direction and project scope.

Requests for substantial changes, alternative concepts, additional editing or new deliverables may be treated as additional work and quoted separately.

9. Copyright & Usage Rights

Unless otherwise agreed in writing, copyright and intellectual property rights in the photographs and video content remain with the respective creator under applicable copyright legislation, including the Icelandic Copyright Act No. 73/1972.

Tungl Media ehf. will grant the client a licence to use the final delivered materials for the purposes, platforms, territories and duration specified in the individual project agreement.

The licence does not automatically include unrestricted, exclusive or transferable usage rights.

Any usage beyond the agreed licence, including extended campaigns, additional platforms, third-party distribution or extended licensing periods, must be agreed upon separately and may incur additional fees.

The client may not resell, sublicense, redistribute or otherwise transfer the delivered materials to third parties unless expressly permitted in writing.

Copyright and ownership are not transferred through the delivery of files or payment of the project fee unless explicitly agreed in writing.

10. Portfolio & Promotional Use

Unless otherwise agreed in writing, Tungl Media ehf. reserves the right to display completed work in its professional portfolio, website, social media and other self-promotional materials.

Where a project involves confidential information, unreleased campaigns, identifiable individuals or other restrictions, any necessary permissions and publication arrangements will be agreed upon separately.

Any agreed confidentiality or publication restrictions will take precedence over this general provision.

11. Payment

Payment terms, including deposits, instalments and final payment deadlines, will be specified in the individual project quote or invoice.

Invoices must be settled within the payment period stated on the invoice.

Where payment is overdue, applicable statutory interest and permitted collection costs may be charged in accordance with Icelandic law.

Unless otherwise agreed, the client's usage licence becomes effective once full payment has been received.

12. Liability

Tungl Media ehf. will exercise reasonable professional care and diligence throughout the production process.

The company is not responsible for delays, limitations or failures resulting from circumstances outside its reasonable control or from inaccurate information, missing permissions or delays caused by the client.

Any liability arising from a project will be assessed in accordance with the applicable agreement and Icelandic law.

Nothing in these terms excludes or restricts liability where such exclusion or restriction is prohibited by law.

13. Applicable Law & Disputes

These terms and any related project agreements are governed by Icelandic law.

Any disputes arising from a project will first be addressed through good-faith discussions between the parties.

Where a dispute cannot be resolved amicably, it may be referred to the competent courts or dispute resolution bodies in accordance with applicable law.

Nothing in this section limits any mandatory consumer rights or jurisdictional protections.

14. Privacy & Personal Information

Personal information provided during enquiries, bookings and project communications will be handled in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR) and Icelandic data protection law.
